The Lower Court of the Bear Clan

PURPOSE

  1. The purpose of this court is to arrive at resolutions for civil matters among commoners of the Bear clan. The court shall have the authority to arbitate on disputes regarding marriages, family rights, adoptions, wills, contracts, and the like.
  2. This court may not try matters among nobles; those are to be referred to the clan leaders and/or her duly appointed proxies. If a noble is involved with a suit with or against a commoner, they may choose to take the matter to the Lower Court, but they also have the right to take the matter to the leadership of the clan.
  3. The judges of this court may, at any time, choose to refer a case to the clan leadership if they feel it is beyond the scope of the court.


PROCEDURE

  1. The judge will hear out both sides of the case and make an appropriate decision.
  2. The hearing may be public or private, at the judge's pleasure. Any party in the case may request the hearing to be public or private, as suits their ends, but making the request does not mean it will be granted.
  3. The parties involved in the case may represent themselves or engage the services of a lawyer or an advocate to represent them, whichever they prefer. A lawyer is not considered essential and will not be provided for those cannot afford one. The judge heading the case has the right to dismiss any lawyer, advocate, or other third party that they find offensive or irrelevant.
  4. The format of the hearing is entirely at the discretion of the judge.


OUTCOME

  1. The judge will weigh the arguments and arrive at a conclusion to resolve the dispute.
  2. This is NOT a criminal court. The judges are not authorized to hand out physical punishments such as flogging, branding, execution, etc. Neither are they authorized to assign jail time or conscription.
  3. The court DOES have the authority to assign fines (either to the other party in the case, to the clan, or both), decide the division of property, make decisions on family names, determine places of residence, assign community service, confiscate property, award child custody, and otherwise assign punishment that does not involve physical punishment, conscription or jail time.


APPEALS AND REVIEWS

  1. The Lower Court is the lowest court of the clan. They are subject to the authority of the clan leader, her proxies, and her ministers.
  2. All rulings of the Lower Court will be reviewed regularly by the clan leader or someone she appoints to do so. This is not an in-depth review evaluating the merits of the case, but rather a cursory review to ensure the judge is acting within her bounds.
  3. The ministry of families reserves the right to review and overthrow the ruling of any case dealing with child custody or any other matter falling within their purview.
  4. Appeals of Lower Court decisions can be made to the clan leader, her proxies, or her minister of justice. Be forewarned that appeals will be denied unless there is a very solid reason for reviewing the case.

JUDGES

All judges of the Lower Court will be appointed by the clan leader. They may be removed at her honour's pleasure.
